Privacy Policy

This Privacy Policy describes how OpenTrucker (“we”, “us”, “our”) collects, uses, discloses and retains information in connection with our websites, applications and related services (collectively, the “Services”). By accessing or using the Services you acknowledge the practices described herein.
1. Information we collect
1.1 Account information. Information you provide when registering or maintaining an account, including identifiers such as a username and email address, and authentication credentials, which are stored in hashed form. Payment card details are collected and processed by our payment processor and are not retained by us.
1.2 Content and records. Information you or your organisation submit through the Services, which may include professional and licensing details, saved routes and preferences, personal trip and compensation records, duty-time summaries, communications, and operational records relating to freight, dispatch and settlement.
1.3 Location information. Certain applications collect device location where you have granted the applicable permission. Depending on the application, location may be collected while the application is in use, or on a continuing basis including when the application is not in the foreground, in order to provide features that depend on detecting vehicle movement and stationary periods. Location collection is subject to operating-system permissions which you may decline or withdraw at any time; the applications remain functional if you do so, with location-dependent features unavailable.
1.4 Technical information. Information generated automatically through your use of the Services, including log data, device and connection information, and diagnostic information used to maintain security and service integrity.
2. Parking availability information
Where your device is stationary at a commercial vehicle stop, it is counted toward how busy that stop is. Those counts, compared against a location's capacity, are what tell other drivers whether somewhere is likely to have room.
What is recorded is a count at a location. Nothing identifies which space a vehicle occupies, and no vehicle's position within a location is stored.
Information contributed for this purpose is de-identified before transmission. It is reduced in precision, associated with a rotating identifier that is changed periodically rather than with your account, and is not stored in a form that permits attribution to an individual user or device. Aggregate figures are published only where a sufficient number of contributing devices is present. Contribution occurs only while a device is stationary; continuous movement and route information are not collected for this purpose.
Such information may also be used to identify locations for possible inclusion in our mapping data. Locations so identified are subject to review before publication.
3. Purposes of processing
We process information to provide, maintain and improve the Services; to establish and administer accounts and authenticate users; to process payments and administer subscriptions; to provide mapping, routing and availability information; to communicate with you regarding the Services; to maintain security and prevent misuse; and to comply with legal obligations.
We do not process personal information for advertising purposes, and we do not sell personal information or disclose it to data brokers.
4. Disclosure
We may disclose information: (a) to an organisation with which you are affiliated through the Services, to the extent that organisation is entitled to such information in connection with your affiliation, including records it is required to maintain; (b) to service providers acting on our behalf, including payment processing, under obligations of confidentiality; (c) where required by applicable law, regulation, legal process or governmental request; and (d) in connection with a merger, acquisition or transfer of assets, subject to this Policy.
Records another party is required by law to retain remain subject to that party's obligations, which this Policy does not modify.
5. Retention, security and your choices
5.1 Retention. We retain information for as long as necessary to provide the Services, to comply with legal obligations, to resolve disputes and to enforce our agreements. Aggregate and de-identified information may be retained without limitation of time.
5.2 Security. We maintain administrative, technical and physical safeguards designed to protect information against unauthorised access, use or disclosure. No method of transmission or storage is entirely secure, and we cannot guarantee absolute security.
5.3 Your choices. You may access and update account information, and may export or delete your account through your account settings. Deletion does not extend to records another party is required to retain, or to de-identified or aggregate information that can no longer be associated with you. You may withdraw operating-system permissions, including location, at any time.
5.4 Children. The Services are directed to commercial users and are not intended for individuals under the age of eighteen. We do not knowingly collect information from such individuals.
6. Changes and contact
We may amend this Policy from time to time. Where an amendment materially affects the categories of information collected or the manner of their disclosure, we will provide notice prior to the amendment taking effect. Continued use of the Services following the effective date constitutes acceptance.
This Policy and any dispute arising in connection with it are governed by the laws of the State of Florida and the applicable laws of the United States, without regard to conflict of laws principles. The Services are operated from the United States.
